Bill Number: HB 4988
Subject: Immigration Status
Sponsor: Jim Lower
MASA Position:
Description: Prohibits certain school policies regarding cooperation with federal officials in retaliation to the immigration status of certain individuals. Prohibits a school district from implementing or adopting a policy that limits an employee or individual working at the school from communicating with federal officials concerning the immigration status of an individual in Michigan. If a school already has a current policy in place that would violate this, then a school has 60 days after the effective date of the legislation to amend that policy. 61 days after this bill goes into effect, school districts that fail to rescind or amend their policy or knowingly adopt one that violates the changes under this bill would result in an action brought against the district in circuit court and a filed complaint with the attorney general. Districts must corporate with an AG investigation. If the court determines that the policy violates this section, they must issue an injunction restraining the districts from implementing that policy, order the district to modify or rescind the policy to be in compliance and award actual damages, etc. to the challenging party. Additionally, if the court finds that the district knowingly and willfully adopted the policy or failed to rescind the modified policy, the court can assess a civil fine between $2,500-$7,500
