MASA Office of Retirement Services (ORS) Lawsuit | Michigan Association of Superintendents & Administrators

MASA has filed a lawsuit against the Office of Retirement Services (ORS) due to the agency’s continued implementation of arbitrary policies that unfairly target superintendents by limiting what legitimate and earned income can be reported for retirement compensation.

The initial complaint was filed with the Michigan Court of Claims on January 25, 2019.

The lawsuit is focused on a concept used by ORS called the Normal Salary Increase, or NSI. The lawsuit seeks to have the NSI declared as unlawful. If found to be unlawful by the court, we would like to have the ORS review the compensation of those affected without application of the NSI.

MASA is engaging in this legal battle because this issue is about fairness, retirement security and, over the long term, ensuring that Michigan has top talent to lead our public school districts well into the future.
